Settlement does not equal payment. After your paraquat case settles, several steps must complete before you receive your net recovery. Here is the realistic timeline.
Settlement agreement signed
The settlement agreement is finalized and signed by all parties. Court approval may be required depending on venue and structure.
Money funded to the QSF
Defendants fund the qualified settlement fund. Funding is typically within 30–90 days of the agreement.
Allocation determination
If your case is part of a global settlement program with points-based allocation, the allocation determination process applies the matrix to your facts and assigns your individual share. This step can take several months.
Lien resolution
Health insurers, Medicare, Medicaid, VA, and hospital liens must be resolved. Lien resolution can be quick or can take months depending on the lien holders and complexity. Skilled lien resolution can substantially increase your net.
Medicare set-asides
If applicable, a Medicare set-aside arrangement is finalized to fund future Parkinson's-related care.
Deductions and disbursement
Attorney fees, case expenses, liens, and any other deductions are applied. The net check is issued.
Realistic timeline
Total time from settlement to net check: typically 3–9 months, sometimes longer for complex lien situations. Communication with your legal team is essential during this period.
