Syngenta makes paraquat. Chevron U.S.A. has been the principal U.S. distributor of paraquat under the Gramoxone brand for decades. Both companies face liability in the paraquat litigation under separate but overlapping theories.

Distributors of defective products generally share liability with manufacturers under product liability doctrine. A distributor that markets, labels, distributes, and benefits commercially from a product cannot escape liability by pointing at the manufacturer.
