Eligibility for a paraquat Parkinson's claim requires a qualifying Parkinson's diagnosis. Not every movement disorder qualifies. Here is what counts.
Idiopathic Parkinson's disease
The core qualifying diagnosis is idiopathic Parkinson's disease, established clinically by a qualified neurologist using standard movement disorder criteria. Movement disorder specialists are preferred over general neurologists for diagnostic accuracy.
Parkinsonism vs Parkinson's disease
'Parkinsonism' is an umbrella term covering Parkinson's disease and atypical parkinsonisms (PSP, MSA, CBD, drug-induced parkinsonism). Atypical parkinsonisms are generally not paraquat-related and do not support a paraquat claim. Differential diagnosis is critical.
What about essential tremor?
Essential tremor is not Parkinson's disease and does not support a paraquat claim. It is the most common movement disorder mimicker of Parkinson's. A thorough neurologic evaluation distinguishes them.
Drug-induced parkinsonism
Parkinsonism caused by neuroleptic and antipsychotic medications is generally reversible and does not support a paraquat claim. Your case should document that your symptoms are not drug-induced.
Imaging and biomarkers
DaT-SPECT imaging supports the clinical diagnosis when features are ambiguous. Routine MRI is typically normal in Parkinson's disease but is helpful to rule out vascular parkinsonism. No single test is definitive — the diagnosis is clinical.
Strengthening the diagnosis
If your treating neurologist is a general neurologist, ask for referral to a movement disorder specialist. A specialist's evaluation strengthens your medical care and your legal case.
