Every reputable paraquat firm works on contingency: the firm gets paid only if you recover. Here is exactly how that works — and what to read carefully in your retainer.
The basic contingency structure
Standard contingency rate in mass tort is one-third of gross recovery. Some firms charge more if the case goes to trial. Reputable retainers spell out the rate and the trigger for each.
Case expenses
Case expenses include filing fees, expert witness fees, court reporter fees, deposition costs, medical records fees, and travel. Expenses can be substantial in mass tort. Most retainers provide that expenses are advanced by the firm and reimbursed from your recovery. Read whether expenses come off the top (before fees) or off the net (after fees) — it changes your take-home.
Lien resolution
If insurance, Medicare, Medicaid, or VA benefits paid for your medical care, those payers may assert liens against your recovery. Lien resolution is part of the legal team's job. Some firms charge a separate fee for lien resolution; most include it in the contingency.
Referral arrangements
Many paraquat claims are referred among firms — the firm you initially contact may not be the firm that handles your case in court. A standard mass tort referral fee is one-third of the attorney fee — not an additional charge to you. The total attorney fee should not exceed the contingency rate in your retainer.
What you actually take home
Roughly: gross settlement minus liens minus case expenses minus attorney fees = your net check. A skilled lien resolution team can substantially increase your net by negotiating lien reductions. Ask your lawyer for a net-recovery estimate before signing the settlement.
Red flags in a retainer
Watch for: contingency rates above 40%, separate fees for routine work (drafting, filing), unclear language about expenses, and language that lets the firm settle without your express written consent. Walk away from any retainer you do not fully understand.
